		<description>In bankruptcy, your pension, other retirement income and qualified retirement savings are protected from creditors in New York and under Federal law.  Therefore, if you file a chapter 7 bankruptcy, your retirement assets are not vulnerable to capture by the chapter 7 trustee.  However, for purposes of the means test, your retirement income, unemployment income and other governmental assistance, if any, are counted as income.  This may or may not disqualify you from chapter 7.  Finally, in a chapter 13 bankruptcy, your retirement income can be used as a source for the repayment of debts in a plan of reorganization, but it is your choice of whether to make a chapter 13 plan work.  Your creditors are otherwise enjoined from attaching to your retirement income.</description>
